These Terms & Conditions (“Terms”) govern access to and use of the Make It Make Sense application, website (www.getmakeitmakesense.com), and related services (collectively, the “Services”) provided by Monkey Fingers LLC (“Company,” “we,” “our,” or “us”).

By using the Services, you agree to be bound by these Terms. If you do not agree, discontinue use immediately.

1. Eligibility & Accounts

  • You must be at least 13 years old to use the Services.

  • You agree to provide accurate, current, and complete information during registration.

  • You are solely responsible for maintaining the confidentiality of your credentials and all activity under your account.

  • We may suspend, restrict, or terminate accounts at our discretion.

2. License to Use

3. User Content

  • By submitting User Content, you grant Monkey Fingers a worldwide, royalty-free, transferable, sublicensable license to store, process, display, and otherwise use the content solely for providing and improving the Services.

  • We reserve the right (but not obligation) to remove User Content that violates these Terms or applicable law.

  • You represent and warrant that you have the rights to all content you upload and that it does not infringe on third-party rights.

4. Prohibited Uses

You agree not to:

  • Violate any applicable laws or regulations.

  • Upload unlawful, harmful, defamatory, or infringing content.

  • Reverse engineer, copy, or attempt to extract source code from the Services.

  • Interfere with the functionality, security, or integrity of the Services.

5. Intellectual Property

  • All intellectual property related to the Services (including trademarks, logos, design, software, and databases) are owned by Monkey Fingers LLC.

  • You may not use our IP without prior written consent.

6. Payments & Subscriptions

  • Certain Services require payment. Prices and terms will be disclosed before purchase.

  • Subscriptions automatically renew unless canceled before the renewal date.

  • We may change pricing or features at any time, with notice as required by law.

  • All payments are non-refundable except as required by law.

7. Disclaimers

  • The Services are provided “as is” and “as available,” without warranties of any kind.

  • Monkey Fingers disclaims all express or implied warranties, including merchantability, fitness for a particular purpose, and non-infringement.

  • AI-generated results are experimental and may be inaccurate. Users should independently verify before relying on them.

8. Limitation of Liability

To the fullest extent permitted by Florida law:

  • Monkey Fingers LLC shall not be liable for any indirect, incidental, consequential, special, or punitive damages, even if advised of the possibility.

  • Our total liability in any claim related to the Services will not exceed the amount paid by you to Monkey Fingers in the 12 months preceding the claim.

9. Indemnification

You agree to defend, indemnify, and hold harmless Monkey Fingers LLC, its officers, directors, employees, and affiliates from any claims, damages, liabilities, costs, or expenses arising out of:

  • Your use of the Services;

  • Your User Content;

  • Your violation of these Terms or applicable law.

10. Governing Law & Disputes

These Terms are governed by the laws of the State of Florida, without regard to conflict-of-law principles. All disputes shall be resolved exclusively in the state and federal courts located in Florida, and you consent to personal jurisdiction there.

11. Termination

We may, at our discretion, suspend or terminate your access to the Services at any time without notice for violations of these Terms or for business or legal reasons.

12. Changes to Terms

We may revise these Terms at any time. Updates will be effective upon posting. Continued use of the Services constitutes acceptance of revised Terms.
